This case challenges a presumption of pretrial detention that applies to nearly all people charged with federal drug offenses.

Xavier Hersom applied for and was denied a gender marker change on his birth certificate. He said DHHR’s policy has created yet another layer of difficulty for him as a transgender person living in West Virginia. The ACLU, the ACLU of West Virginia, and the Harvard Law School LGBTQ+ Advocacy Clinic filed a federal lawsuit asking a court to declare West Virginia’s birth certificate policies relating to transgender people unconstitutional on behalf of Hersom and an another anonymous plaintiff.

West Virginia abortion providers and advocates filed a lawsuit in federal court challenging multiple provisions of HB 302, the state’s near-total abortion ban passed in 2022. Plaintiffs in the case sought an injunction blocking the entire ban while providers made their case in court.

Following the decision by the U.S. Supreme Court to overturn Roe v. Wade – the landmark decision that acknowledged the right to an abortion to millions of Americans for nearly five decades – West Virginia medical providers and advocates filed a lawsuit on June 29, 2022 to prevent the enforcement of an archaic and cruel abortion ban in state court.
