Court Hearing Thursday in ACLU Challenge to NSA Phone Spying Program

WHAT:
Initial pretrial and pre-motion conference in ACLU v. Clapper, the American Civil Liberties Union’s lawsuit challenging the constitutionality of the NSA’s mass collection of phone records. The parties will outline their arguments and discuss how the case will be litigated. The discussion will include what kinds of motions can be filed, such as a motion for a preliminary injunction, and whether discovery is necessary.
It will be the first time the government addresses the NSA surveillance program in court. The ACLU’s Freedom of Information Act lawsuit seeking the government’s secret interpretations of Patriot Act Section 215 will also be discussed.
WHO:
ACLU Deputy Legal Director Jameel Jaffer, ACLU Staff Attorney Alex Abdo, and attorneys from the Justice Department will appear before Judge William H. Pauley III.
