ACLU Comment on Senate Introduction of Bill to Ensure Due Process for Children Facing Deportation

WASHINGTON — U.S. Senate leaders today introduced legislation to ensure due process for children facing deportation. The Fair Day in Court for Kids Act of 2016 was introduced by U.S. Sens. Harry Reid (D-Nev.), Dick Durbin (D-Ill.), Patty Murray (D-Wash.), Patrick Leahy (D-Vt.), and Robert Menendez (D-N.J.). The measure would require the federal government to appoint immigration counsel to unaccompanied children and vulnerable individuals, including those with disabilities and survivors of abuse, torture, or violence.

Joanne Lin, American Civil Liberties Union legislative counsel, said:

“It is outrageous that our government is raiding homes and detaining families and children, including those with no legal representation, for immediate deportation. We know that having a competent attorney can make the difference between life and death. The ACLU urges Congress to swiftly pass this measure to ensure due process and fairness for children and families fleeing persecution and brutal violence.”
