ACLU Comment Regarding Tenant Protections for Enterprise-Backed Multifamily Properties

On July 31, 2023, the ACLU submitted a comment to the Federal Housing Finance Agency (“FHFA”) in response to a request for input on tenant protections applicable to enterprise-backed multifamily properties. In its comment, the ACLU urged the FHFA to use its authority as supervisor and conservator of government sponsored enterprises to address unfair and discriminatory practices that result in potential tenants being denied access to housing, such as policies and practices that exclude based on criminal and eviction history records or source of income and “crime-free housing programs.” The ACLU also urged other requirements for properties backed by government sponsored enterprises, including notice of tenant screening criteria and the bases for rejections, as well as notice of rights and responsibilities relating to sexual harassment in housing.
