Whether the Department of Homeland Security lawfully issued an administrative Guidance deferring removal, and granting work authorization, to the undocumented parents of U.S. citizens and permanent residents who meet designated eligibility criteria.
Summary
The so-called DAPA program announced by the Obama administration has been challenged on both procedural and substantive grounds. The substantive objection is that it exceeded the authority granted by Congress despite the fact that similar directives have been issued by administrations of both parties for the past 50 years. The ACLU joined a broad coalition of civil rights groups in an amicus brief highlighting the personal hardships that the DAPA program was meant to alleviate.
