The issue in this case is whether the prosecution should be barred from relying on any statements made by a defendant who has been deliberately questioned by the police without Miranda warnings even if the defendant repeats the statements a short time later after warnings are given. The ACLU brief documents the extent to which the practice of questioning suspects “outside Miranda” has now become commonplace. It also argues that exclusion is necessary to deter such deliberate violations of Miranda and to preserve the rule of law.
